El género textual de la denuncia en español: análisis, caracterización y su traducción al inglés

    La clasificación por géneros textuales puede ser de gran utilidad a la hora de enfrentarse a la traducción de un texto de naturaleza jurídica. La legislación española reconoce el derecho del denunciante a recibir una traducción escrita de la denuncia siempre y cuando no conozca el idioma en el que está redactada. No obstante, el género textual de la denuncia parece haber pasado desapercibo en el ámbito académico de la traducción jurídico-administrativa. Es por ello por lo que en esta investigación analizaremos un corpus formado por dieciséis denuncias en español interpuestas ante el Cuerpo Nacional de Policía entre 2011 y 2022 con un doble objetivo: por un lado, caracterizar el género textual de la denuncia en español a nivel macro y microtextual; y, por otro, establecer el contexto en el que este género textual se traduce al inglés británico, identificar los problemas que aparecen en el proceso traductológico y elaborar una serie de propuestas para solucionarlos basadas en una estrategia de traducción híbrida destinada a preservar los elementos propios del ordenamiento jurídico origen y guiar al receptor del texto meta a través de ellos.

    Text genre classification may become an extremely useful tool when translating a legal text. While it is true that Spanish legislation acknowledges the right of every complainant to receive a translated copy of their witness statement if they do not know the language in which it is written, the legal text genre witness statement seems to have gone unnoticed for researchers in the field of legal-administrative translation. This is the reason why in this paper we will analyse a corpus formed by sixteen witness statements or denuncias in Spanish given before the Cuerpo Nacional de Policía [Spanish National Police] between 2011 and 2022, so as to fulfil a double objective: firstly, to characterise the text genre witness statement in Spanish at both macro and microtextual levels; and, secondly, to point out the communicative context in which this genre is translated into British English, identify the challenges that the translator may face and develop a series of translation solutions based on a hybrid translation strategy whose aim is to preserve the unique elements of the source legal system while guiding the target text receiver through them.
