La actuación policial con menores infractores detenidos en España

    En el presente trabajo se analiza el régimen jurídico de la actuación policial con menores infractores detenidos en España, que se recoge de forma sistematizada en la Instrucción de la Secretaría de Estado de Seguridad 1/2017, de 24 de abril, por la que se actualiza el “Protocolo de Actuación Policial con Menores”. En este Protocolo, que incorpora las modificaciones normativas producidas en esta materia en los últimos años, así como las directrices impartidas al respecto por la jurisprudencia y la Fiscalía, se recoge la organización y especialización de los distintos cuerpos policiales en su actuación en materia de menores y se fija el régimen de la actuación policial con menores en todos los ámbitos (menores infractores penales entre catorce y dieciocho años, menores víctimas o testigos, menores infractores de la normativa de seguridad ciudadana, menores en situación de riesgo y desamparo o menores desaparecidos), actuación que está claramente imbuida de los postulados de la Justicia Terapéutica. No obstante, nos limitaremos a analizar y comentar aquellos extremos relativos a la actuación policial con los llamados “menores infractores penales”, es decir, menores con edad comprendida entre los catorce y los dieciocho años a los que se les imputa participación en un hecho delictivo y que han sido detenidos por la Policía. En este sentido, tras la exposición de las particularidades que presenta la detención de un menor en lo relativo a su duración y a los derechos y garantías de que goza durante la misma, se exponen los aspectos esenciales del trato que las Fuerzas y Cuerpos de Seguridad deben dispensarle desde el momento de su detención hasta que es puesto en libertad o a disposición del Fiscal de Menores (forma de practicar la detención, traslado y custodia del menor, identificación y reconocimiento del menor detenido, etc.), centrándonos particularmente en la asistencia letrada que se le debe prestar en las dependencias policiales.

    This paper analyses, the legal regime of police action with juvenile offenders arrested in Spain, which is systematized in the Instruction of the Secretary of State for Security 1/2017, of April 24, which updates the “Protocol for Police Action with Minors”. In this Protocol, which incorporates the regulatory modifications produced in this area in recent years, as well as the guidelines given in this regard by the jurisprudence and the Prosecutor's Office, the organization and specialization of the different police forces in their actions in the matter of minors is included, and the regime of police action with minors is established in all areas (juvenile criminal offenders between fourteen and eighteen years of age, minors who are victims or witnesses, juvenile offenders of citizen security regulations, minors in situations of risk and helplessness or missing minors), actions that are clearly imbued by the postulates of Therapeutic Jurisprudence. However, we will limit ourselves to analyzing and commenting on those points related to police action with so-called “juvenile criminal offenders”, that is, minors between the ages of fourteen and eighteen who are accused of participating in a criminal act and who have been arrested by the police. In this sense, after the presentation of the particularities that the detention of a minor presents in relation to its duration and the rights and guarantees enjoyed during it, the essential aspects of the treatment that the law enforcement authorities must dispense the minor from the moment of their arrest until they are released or at the disposal of the Prosecutor for Minors (including the way of carrying out the detention, transfer and custody of the minor, identification and recognition of the minor detained, etc.) are presented, paying particular attention to the legal assistance that must be provided at police stations.
