Resumen de Análisis jurídico sobre la insolvencia en el Ecuador

  El objetivo general de la investigación fue el análisis jurídico sobre la insolvencia en el Ecuador. El planteamiento realizado por los investigadores para el desarrollo de la metodología, fue a partir del enfoque cuantitativo, mediante la indagación, recolección, análisis crítico documental y referencial bibliográfico, basándose en la exploración metódica, rigurosa y profunda de diversas fuentes documentales conformadas por artículos, normas y leyes, tesis, entre otros, describiendo los hallazgos encontrados. Se empleó la técnica de la revisión documental. Se recurrió, además, al método inductivo-deductivo. Describiendo así, los hallazgos encontrados, permitiendo desarrollar el cuerpo teórico en relación al tema de estudio. Se concluye que, los juicios sobre la insolvencia, suelen ser extensos, hasta llegar a una resolución judicial, y por ende a un mandamiento de ejecución, que da lugar a un proceso concursal. Es necesario la existencia de una de Ley sobre la Insolvencia que regule todo lo referente a los procedimientos.

  The general objective of the research was the legal analysis of insolvency in Ecuador. The approach taken by the researchers for the development of the methodology was based on the quantitative approach, through the inquiry, collection, critical documentary analysis and bibliographic reference, based on the methodical, rigorous and deep exploration of various documentary sources consisting of articles, rules and laws, theses, among others, describing the findings. The documentary review technique was used. The inductive-deductive method was also used. Thus, the findings were described, allowing the development of the theoretical body in relation to the topic of study. It is concluded that insolvency trials tend to be extensive, until they reach a judicial resolution, and therefore an execution order, which gives rise to a bankruptcy proceeding. It is necessary the existence of an Insolvency Law that regulates everything related to the proceedings.
