    La corrupción política es ciertamente percibida como uno de los mayores males del Estado Democrático de Derecho. En algunos ordenamientos jurídicos, de hecho, el soborno del político tiene una regulación penal ad hoc. En España, en cambio, en línea con los principales instrumentos jurídicos internacionales, para efectos de aplicación del delito de cohecho, el concepto penal de funcionario público se ha entendido desde siempre como comprensivo de toda persona que ejerce una función pública legislativa, judicial y administrativa, sin que el legislador penal haya considerado nunca diferenciaciones relacionadas ni con el tipo de función ni con su trascendencia ni mucho menos con el distinto poder. Por otra parte, en una perspectiva de lege ferenda, diferenciar al "político" del "funcionario administrativo" o "judicial" no parece tarea sencilla.

    Political corruption is certainly perceived as a very disease for democracy. Some legislation established an ad hoc offense related to the bribery of the politician. On the contrary, in Spain, in line with the most important international legal instruments related to the fight against corruption, the concept of public official (liable for bribery) is not anchored to a liberal division-of-powers approach: for the purpose of the criminal anti-bribery law, a legislator, a judicial or an administrative officer can be considered "official" and criminal law does not establish any difference taking into account the importance of the public function or the brunch in which it is played. Under a de lege ferenda point of view, it is not simple to establish such a distinction and even establishing the very concept of "politician" can be problematic.
