Resumen de El fuero de Soria y la regulación de la prescripción adquisitiva durante el siglo XIV. Influencia del Ordenamiento de Alcalá.

El carácter obligatorio de las disposiciones recogidas en el Ordenamiento de Alcalá (08/02/1348), acompañado por el sistema de prelación de fuentes establecido en éste pudo provocar la modificación, por razones de pragmatismo, en la redacción de los correspondientes textos que recogían las normas forales. Esto supongo que ocurrió con el texto hoy depositado en el Archivo Histórico Municipal de Soria, que contiene una regulación de la prescripción adquisitiva distinta a la del texto conservado en la Biblioteca Nacional de España y más ajustada a lo dispuesto en el Ordenamiento. En base a ello, entiendo que se puede establecer que el texto del Fuero de Soria conservado en la Biblioteca Nacional de España fue realizado antes y el depositado en el Archivo Histórico Municipal de Soria después del 8 de febrero de 1348. La cuidada confección del primero de los citados manuscritos permite suponer que se hizo para su presentación por la “Gran Hermandad” ante el rey Alfonso XI y sus tutores en 1315.

The obligatory nature of the provisions contained in the Ordinance of Alcalá (08/02/1348), accompanied by the system of priority of sources established in it, could be cause to the modification, for pragmatism reasons, in the drafting of the corresponding texts that included the foral norms. This I suppose happened with the text today deposited in the Municipal Historical Archive of Soria, which contains a regulation of the acquisitive prescription different from that of the text preserved in the Biblioteca Nacional de España and more adjusted to the provisions of the Ordinance. Based on this, I understand that it can be established that the text of the Fuero de Soria preserved in the National Library of Spain was made before and the one deposited in the Municipal Historical Archive of Soria after February 8, 1348. The careful preparation of the first of the aforementioned manuscripts allows us to suppose that it was made for presentation by the "Great Brotherhood" before King Alfonso XI and his tutors in 1315.
