Se tiene como objetivo analizar la conculcación de los derechos fundamentales del investigado a través del pasado judicial, así como indagar la normativa existente a fin de evitar discriminación penal y social en la realidad ecuatoriana. Se llevó a cabo un estudio descriptivo documental, mediante la técnica de la revisión bibliográfica. La conculcación se mide mediante las violaciones de los derechos de las personas, en este caso de las personas que atraviesan un proceso judicial, que cumplieron una pena o que después de las investigaciones pertinentes fueron declarados inocentes, sin embargo, en el estado ecuatoriano en el ordenamiento jurídico no se estructura leyes que colaboren con estos casos, simplemente se instaura que es su obligación respetar, proteger, garantizar y promover los derechos, por esta razón se encontró conveniente la promulgación de políticas públicas que avalen estas obligaciones.
The objective is to analyze the violation of the fundamental rights of the investigated through the judicial past, as well as to investigate the existing regulations in order to avoid penal and social discrimination in the Ecuadorian reality. A descriptive documentary study was carried out by means of the bibliographic review technique. The violation is measured through violations of the rights of people, in this case of people who are going through a judicial process, who served a sentence or who after the relevant investigations were declared innocent, however, in the Ecuadorian state in the legal system there is no structure of laws that collaborate with these cases, it is simply established that it is its obligation to respect, protect, guarantee and promote rights, for this reason it was found convenient the enactment of public policies that support these obligations.
