  Se tiene por objetivo analizar la posible vulneración al derecho de las víctimas contemplado en el artículo 11 numeral 1 del Código Orgánico Integral Penal al establecer que una defensa técnica privada o pública actué en la audiencia de juicio sin su voluntad en el cantón Cuenca Provincia del Azuay entre el mes de marzo a julio del 2021. Para cesar la vulneración de derechos en la audiencia de juicio se debería enviar una consulta a los dos organismos máximos de interpretación como los son Corte Constitucional y la Corte Nacional de Justicia para que se pronuncien sobre la interpretación de la norma realizada por la Sala Especializada de lo Penal Militar, Penal Policial y Transito de la Corte Provincial de Justicia del Azuay dentro de la causa 01282-2018- 01573.
