    El terrorismo constituye una de las principales amenazas para nuestras democracias avanzadas y un atentado sobre los valores en los cuáles estas se sustentan. En muchos casos la respuesta de los Estados miembros del Consejo de Europa a tan cambiante fenómeno ha tenido un impacto decisivo en clave de derechos, aquellos reconocidos y garantizados a través del sistema europeo de protección, único sistema que genera obligaciones vinculantes para el Estado. Desde sus primeros pronunciamientos, el TEDH ha tenido oportunidad de pronunciarse sobre las vulneraciones de derechos asociados a la práctica terrorista y su respuesta estatal a partir de los instrumentos que ofrece el estado de Derecho y en base a una jurisprudencia evolutiva que no ha sorteado ni las medidas más controvertidas ni tampoco los avances técnicos y legales en la lucha contra el terror.

    Terrorism is one of the main threats to our advanced democracies and an attack on the values on which they are based. In many cases, the response of the member states of the Council of Europe to such a changing phenomenon has had a decisive impact in terms of rights, those recognized and guaranteed through the European system of protection, the only system that generates binding obligations for the State. Since its first pronouncements, the ECtHR has had the opportunity to rule on the violations of rights associated with the terrorist practice and its state response based on the instruments offered by the rule of law and based on an evolutionary jurisprudence that has not circumvented neither the most controversial measures nor the technical and legal advances in the fight against terror.
