  En el ordenamiento jurídico español, las comunidades de propietarios en régimen de propiedad horizontal carecen de personalidad jurídica. Dicha falta de atribución, acompañada de la gran importancia e implantación que tiene esta institución en nuestra sociedad, hace que surjan numerosos problemas en el tráfico jurídico. Uno de los de mayor trascendencia es la imposibilidad de inscribir derechos en el Registro de la Propiedad a favor de tales comunidades. El Estado se encuentra ante una serie de problemas que debe solucionar en aras de una mayor seguridad y agilidad.

  The communities of property owners within the legal framework of the Commonhold Act lack legal personality. The absence, along with the Paramount importance which define this institution in our society, causes the appearance of numerous problems in the sphere of mass market consumer transactions. The inability to register rights in the Land Registry related to the abovenamed communities is regarded as one of the greatest problems of the system. The Government is facing a wide range of conflicts which require its attention and prompt solution to ensure a high degree of security and dynamism.
