    Unlike most other parts of the Portuguese empire, it was not until the 1760s that municipal institutions were transferred to Portuguese East Africa. Despite this singularity, the study of municipalities in colonial Mozambique has received scant attention in the literature. The aim of this paper is to reflect upon Mozambique Island municipality from the date of its creation (1763) until the end of the eighteenth-century regarding access to land and property rights. It does this by examining how land located in Mozambique Island and its outskirts was framed under Portuguese colonial rule, and by analysing the impact of the municipality creation regarding property matters. It argues that the legal system framing land tenure and landownership in Mozambique Island was also the prazo system of Mozambique and that, from 1763 onwards, the direct domain over land was shared between the Captaincy’s general government and the municipal council.

    Contrairement à la plupart de l'empire portugais, ce n'est que dans les années 1760 que les municipaux ont été transférées en Afrique orientale portugaise. Malgré cette singularité, l’étude des municipalités au Mozambique colonial n’a guère retenu l’attention dans la littérature. Cet article vise réfléchir sur la municipalité de l’île de Mozambique de 1763 à la fin du XVIIIe siècle en ce qui concerne l’accès à la terre et aux droits de propriété. Pour cela, il examine la manière dont les terres situées sur l’île de Mozambique et ses banlieues ont été encadrées par le régime colonial portugais et analyse l’impact de la création de la municipalité sur les questions de propriété. Il fait valoir que le système juridique qui a encadré la régime foncier et la propriété foncière sur l'île de Mozambique était aussi le système de prazos du Mozambique et que, à partir de 1763, le domaine direct sur la terre a était partagé entre le gouvernement général et la municipalité.

    Ao contrário da generalidade do império português, só na década de 1760 a instituição municipal foi transferida para os domínios leste-africanos. Apesar desta particularidade, o estudo dos municípios no Moçambique colonial tem sido, de um modo geral, negligenciado pela historiografia. Neste trabalho propõe-se uma reflexão sobre a vila e o município da Ilha de Moçambique desde a data da sua criação, em 1763, até ao final do século XVIII sob o ponto de vista da administração das terras localizadas dentro da circunscrição concelhia. Argumenta-se que também na Ilha de Moçambique o regime que enquadrou a posse e a propriedade da terra foi o regime dos prazos de Moçambique e que, de 1763 em diante, o domínio eminente sobre a terra passou a ser partilhado entre o governo-geral da capitania e a câmara.
