La libertad de expresión artística de los fotógrafos: la protección de sus creaciones por la propiedad intelectual y como vía para la conservación del patrimonio cultural

    El presente trabajo analiza la libertad de expresión artística de los fotógrafos y la pro-tección de los frutos derivados de su creación. Estos se tutelan por la propiedad intelectual como obras, sujetas a derecho de autor, y como meras fotografías, por derechos afines o «conexos», dependiendo de si resultan originales. A la luz de esta doble vía, las fotografías serán las creaciones que mayor protección tendrán por la propiedad intelectual. Esta protec-ción, esencialmente inmaterial, se proyectará asimismo sobre la conservación del patrimonio cultural a través del derecho moral del autor a exigir el respeto a la integridad de su obra.

    This paper analyses photographers’ freedom of artistic expression and the protection of the results derived from their creation. These are protected by intellectual property as works, subject to copyright, and as mere photographs, by «neighbouring» or «related» rights, depending on whether they are original. In the light of this double track, photographs will be the creations that will have the greatest intellectual property protection. This protection, which is essentially immaterial, will also affect the preservation of cultural heritage through the moral right of the author to demand respect for the integrity of his or her work.
