Datos biométricos y acceso a eventos deportivos. Comentarios al Informe de la AEPD

    La Agencia Española de Protección de Datos (AEPD), a través de su Gabinete Jurídico, emitió el 20 de enero de 2023, Informe núm. 0098/2022, en el que responde a una consulta sobre si sería viable jurídicamente que el CEVRXID, Comisión Estatal contra la Violencia, el Racismo, la Xenofobia y la Intolerancia, en el ámbito de sus competencias, estableciera medidas para el cumplimiento de los clubes consistentes en la instalación de sistemas biométricos que permita la identificación unívoca de los aficionados que accedan las gradas de animación. Para el tratamiento de datos biométricos, resulta necesario que concurra alguna de las excepciones recogidas en el artículo 9.2 RGPD y en este sentido, la AEPD recuerda que no se puede llevar a cabo esta identificación biométrica, de forma única u obligatoria, amparándose en el interés público esencial (art. 9.2.g RGPD), sin que esto esté previsto y desarrollo en una norma con rango de ley, que actualmente no existe.

    The Spanish Data Protection Agency (AEPD), through its Legal Office, has issued Report No. 0098/2022, in which it responds to a consultation on whether the CEVRXID, State Commission against Violence, Racism, Xenophobia and Intolerance, within the scope of its competences, establishing measures for the compliance of the clubs consisting in the installation of biometric systems for the control of all the accesses to the cheering stands that allow the univocal identification of the fans that access to these stands, would be legally feasible. For the processing of biometric data, it is necessary that one of the exceptions listed in Article 9.2 of the GDPR is met and in this sense, the AEPD recalls that this biometric identification cannot be carried out, in a unique or mandatory way, under the essential public interest (art. 9.2.g of the GDPR), without this being provided for and developed in a regulation with the status of law, which currently does not exist.
