El Tribunal Supremo resuelve sobre la licitud de una cláusula de exclusión en un seguro de accidentes y su sujeción al artículo 3 LCS. La cláusula es limitativa de los derechos de la asegurada porque elimina la obligación de indemnizar cuando el asegurado tenga un nivel determinado de embriaguez, de modo que se discute si se cumplen los deberes de transparencia y la autenticidad de la firma del asegurado.

The Supreme Court resolves on the legality of an exclusion clause in accident insurance and its subjection to article 3 LCS. The clause is limiting the rights of the insured because it eliminates the obligation to indemnify when the insured has a certain level of drunkenness, so that it is discussed whether the duties of transparency and the authenticity of the insured's signature.
