    RESUMEN:

    El novedoso delito de desobediencia del art. 438 bis CP está encaminado a la lucha contra la corrupción y castiga, no el enriquecimiento ilícito de la autoridad, sino el negarse abiertamente a justificar un incremento patrimonial que no se corresponde con sus ingresos o bienes precedentes, debiéndose acreditar que el incremento patrimonial no justificado es superior a 250.000 euros.

    The new offence of disobedience of art. 438 bis PC is aimed at the fight against corruption and punishes, not the illicit enrichment of the authority, but the open refusal to justify an increase in assets that does not correspond to their previous income or assets, having to prove that the unjustified increase in assets is greater than 250,000 euros.
