La protección constitucional del beneficio de la inmunidad en el congreso peruano

    La finalidad del presente proyecto es analizar la institución de la inmunidad parlamentaria, el mismo que está consignado en el texto Constitucional en forma expresa en el artículo 93. Al enfoque de los postulados constitucionales y la forma democrática de gobierno en el país surge preguntas, ¿Si la inmunidad es compatible con un país democrático y el estado Constitucional de Derecho? En esa línea el fin de la presente investigación es demostrar que en nuestro país el beneficio de la inmunidad que gozan los congresistas es una coraza que les permite tener impunidad, y ello conlleva a que no se les pueda investigar y menos sancionar cuando toda la población conoce que habrían cometido ilícitos que tiene que ver con delitos, que hacen quedar muy mal la imagen de uno de los poderes del estado como es el Poder Legislativo. La metodología es de tipo cualitativo, y se tomará en cuenta casos concretos, así como la opinión pública respecto a la labor del congreso, y particularmente a lo que atañe a la figura de la inmunidad, en las alternativas de solución se plantea que debe reformarse la figura de la inmunidad, a fin de no aumentar la impunidad y mejorar la mala imagen del parlamento peruano.

    The purpose of this project is to analyze the institution of parliamentary immunity, which is stated in the Constitutional text expressly in article 93. Along these lines, the purpose of the present investigation is to demonstrate that in our country the benefit of immunity enjoyed by congressmen is a breastplate that allows them to have impunity, and this implies that they cannot be investigated and less sanctioned when the entire population He knows that they would have committed crimes that have to do with crimes, which make the image of one of the powers of the state as the Legislative Power very bad. The methodology is of a qualitative type, and specific cases will be taken into account, as well as public opinion regarding the work of the congress, and particularly with regard to the figure of immunity, in the solution alternatives it is proposed that it should be reformed the figure of immunity, so as not to increase impunity and improve the bad image of the Peruvian parliament.
