Régimen sancionador deportivo de Andalucía: Luces y sombras de la nueva regulación

    El presente trabajo pretende analizar el nuevo Tribunal Administrativo del Deporte de Andalucía en sus primeros años de actuación, ya que supone una nueva realidad en la aplicación del régimen disciplinario deportivo andaluz, donde se han puesto en evidencia diferentes peculiaridades sobre su fundamentación orgánica, composición y desarrollo de su propia actividad. Supone el máximo órgano de intervención disciplinaria administrativa en el ámbito deportivo de la Comunidad Autónoma de Andalucía, que a pesar de disponer un marco de actuación perfectamente delimitado, abarca también funciones para las que se requiere por el ordenamiento cualificaciones que la disposición reguladora no determina, considerando igualmente, que sus miembros ostentan una muy particular relación jurídica con la Administración pública destinataria de sus servicios, objeto asimismo de análisis.

    The present work intends to analyze the new Andalusian Sports Administrative Court in its first years of operation, since it represents a new reality in the application of the Andalusian sports disciplinary regime, where different peculiarities have been evidenced about its organic foundation, composition and development of its own activity. It is the highest body of administrative disciplinary intervention in the sports field of the Autonomous Community of Andalusia, which despite having a perfectly delimited framework of action, also covers functions for which qualifications are required by the legal system that the regulatory provision does not determine, also considering that its members have a very particular legal relationship with the Public Administration that is the recipient of their services, which is also the object of analysis.
