La reciente evolución de la regla de prevalencia del derecho estatal en la doctrina constitucional

    En el presente estudio se analiza la doctrina del Tribunal Constitucional sobre el significado y función de la regla de la prevalencia del Derecho estatal que establece el art. 149.3 de la Constitución. Algunas decisiones recientes del Tribunal Constitucional han ofrecido una interpretación algo distinta de la que venía siendo tradicional, permitiendo la inaplicación de las leyes autonómicas en determinados supuestos. El artículo pretende dar cuenta de la evolución de dicha doctrina del Tribunal y su situación en el momento actual.

    The present study analyzes the doctrine of the Constitutional Court on the meaning and function of the rule of the prevalence of state law that establishes article 149.3 of the Constitution. Recent rulings of the Constitutional Court offer a somewhat different interpretation of the traditional understanding of the precept allowing the non-application of regional laws in certain cases. The article aims to give an account of the evolution of the Court’s doctrine and its current situation.
