    Il saggio propone una rilettura delle controversiae 4.8 e 9.3 di Seneca il Vecchio, che può offrire un contributo alla migliore comprensione degli strumenti giuridici a tutela di chi avesse compiuto attività di rilievo giuridico in situazione di timore. I retori si concentrano sulla questione della volontà, che deve essere libera, e argomentano analizzando due casi limite che aiutano a meglio comprendere l’ipotesi in cui un atto giuridico fosse compiuto in situazione di metus non indotto da controparte.

    This essay proposes a reading of the controversiae 4.8 and 9.3 of Seneca the Elder, which may offer a contribution to a better understanding of the means protecting those who performed legally relevant activities in a situation of fear. The rhetoricians focus on willing, which must be free, and argue by analysing two borderline cases that help to better understand the hypothesis in which a legal act was performed in a situation of metus not induced by the other party.
