La responsabilidad del legislador, en sus tres modalidades, se encuentra regulada en la Ley 40/2015, si bien los requisitos y condiciones que en ella se prevén distan mucho de ser acordes con los principios del Derecho comunitario, con los postulados constitucionales y con la reiterada jurisprudencia del Tribunal Supremo. En este trabajo se trata de analizar y dar cuenta de las debilidades y carencias del sistema, sumándose así a la reivindicación de reforma que viene a postular la reciente Sentencia del Tribunal de Justicia de la Unión Europa de 28 de junio de 2022 y la reciente jurisprudencia del Tribunal Supremo

The three types of legislature’s liability are regulated in the Law 40/2015, although the conditions and requirements are in breach with the Union Law, with the constitutional postulates and the repeated case-law of the Supreme Court. This paper analyzes the weakness. and deficiencies of the system, in accordance with the claim to fulfil its obligations established by the Judgment of the Court of 28 June 2022 and the recent case-law of the Supreme Court.
