Este artículo examina críticamente la argumentación de la STJ 28/06/2022, Comisión/España, C-278/20, relativa a las exigencias de los principios de efectividad y equivalencia con los que se contrasta la regulación española de la acción para pedir responsabilidad del Estado legislador por leyes que infrinjan del Derecho de la Unión. Al final se realiza una propuesta sobre cómo debería articularse dicha regulación tras la declaración de incumplimiento contenida en la sentencia comentada.

This article critically examines the argumentation of the Judgment of the EUCJ of June 28, 2022, Commission/Spain, C-278/20, regarding the require-ments of the principles of effectiveness and equivalence with which the Spanish provisions regulating the action of liability for loss or harm caused to individuals by breaches of EU law attributable to the national legislature are contrasted. At the end, a proposal is made on how the new provisions should be articulated after the declaration of Spain ́s failure to fulfil its obligations.
