Resumen de La privacidad de los datos personales en el deseado Registro Civil electrónico: Especial referencia a las personas con discapacidad

El nuevo Registro Civil electrónico, regulado por Ley 20/2021, de reciente entrada en vigor y modificada por Ley 6/2021, de 28 de abril, debe seguir siendo un instrumento imprescindible para la seguridad jurídica, garantizando la protección de datos de acuerdo con la Ley Orgánica 3/2018. En materia registral deberán conyugarse de manera adecuada el derecho a la intimidad de sus ciudadanos con el principio de publicidad registral, sin perjuicio del tratamiento protegido de los datos sensibles, que requerirán de autorización de su titular. Y si el mismo es una persona con discapacidad, el Registro Civil debe hacer constar las medidas de apoyo que requiera para el ejercicio de su capacidad jurídica de acuerdo con la nueva Ley 8/2021.

The new electronic Civil Registry, regulated by Law 20/2021, of July 21, of the Civil Registry of recent entry into force and modified by Law 6/2021, of April 28, must continue to be an essential instrument for legal certainty, guaranteeing the protection of data in accordance with Organic Law 3/2018, of December 5, on the Protection of Personal Data. In registration matters, the right to privacy of its citizens must be adequately combined with the principle of registration publicity. Said adaptation must respect the protected treatment of sensitive data, which will require authorization from its owner. If said owner is a person with a disability, the Civil Registry must record the support measures required for the exercise of their legal capacity, in accordance with the new Law 8/2021, of June 2, which reforms the civil and procedural legislation to support people with disabilities in the exercise of their legal capacity.
