De la reforma suiza del Derecho sucesorio

    Analizamos la Ley federal suiza, de dieciocho de diciembre de 2020, de reforma del Derecho sucesorio, que entrará en vigor el uno de enero de 2023, valorando las causas alegadas por el promotor de la iniciativa y su conexión con la reforma. También reflexionamos sobre las uniones civiles —que incluyen el matrimonio y las parejas de Derecho— para distinguirlas de las parejas de hecho. Por último, presentamos una teoría jurídicamente pura sobre las transmisiones patrimoniales entre esposos y la usamos para reflexionar sobre las que se producen en el régimen económico-matrimonial y el derecho sucesorio.

    We analyze the Swiss Federal Law of 18 December 2020 on the reform of inheritance regulation, which will enter into force on 1 January 2023, evaluating the causes put forward by the promoter of the initiative and its connection with the reform. We also reflect on registered unions - which include marriage and legal partnerships - to legally distinguish them from unregistered couples. Finally, we present a pure legal theory of property transfers between member of the registered union and use it to evaluate those that occur in the frame of the economic-marital regime and the law of inheritance.
