Resumen de Análisis y aplicación de los Derechos Fundamentales: una mirada desde la legislación ecuatoriana durante el periodo 2020-2021

El estudio que se plantea a través de este artículo científico se fundamentó en analizar la importancia de la protección de los derechos fundamentales en el marco del sistema jurídico ecuatoriano, considerando los grandes cambios y acontecimientos que han intervenido en el desarrollo a nivel nacional e internacional y así brindar una guía, desde la perspectiva doctrinal y jurídica para tener un acercamiento a la realidad vivida sobre esta temática. A través de la aplicación de una metodología basada en el análisis jurídico-doctrinal y el método exegético jurídico, fueron revisadas y analizadas en la normativa y jurisprudencia internacional, fuentes bibliográficas que facilitaron el análisis y estudio abordado. Los resultados obtenidos permitieron comprobar que las tendencias internacionales, en especial las europeas, han tenido una gran influencia en la evolución de los derechos fundamentales en Ecuador. Sin embargo, los datos estadísticos abordadas a través de la revisión documental, denotan que durante el periodo estudiado 2020-2021, el problema relacionado con la vulneración de los derechos fundamentales en el Ecuador se agudizo, situación que impulsa la necesidad de que el Estado ecuatoriano siga reformulando políticas y acciones que permitan equilibrar los fundamentos constitucionales y los instrumentos internaciones que respaldan el resguardo de los derechos de la población ecuatoriana, con la realidad que se vive día a día y así poder recibir respuestas oportunas por parte de los operadores de justicia, lo cual permita claridad, unificación y concientización.

The study that arises through this scientific article was based on analyzing the importance of the protection of fundamental rights within the framework of the Ecuadorian legal system, considering the great changes and events that have intervened in development at the national and international level and thus provide a guide, from the doctrinal and legal perspective to have an approach to the reality lived on this subject. Through the application of a methodology based on the legal-doctrinal analysis and the legal exegetical method, bibliographic sources that facilitated the analysis and study addressed were reviewed and analyzed in international regulations and jurisprudence. The results obtained allowed us to verify that international trends, especially European ones, have had a great influence on the evolution of fundamental rights in Ecuador. However, the statistical data addressed through the documentary review, denote that during the period studied 2020-2021, the problem related to the violation of fundamental rights in Ecuador became more acute, a situation that drives the need for the Ecuadorian State continue reformulating policies and actions that allow balancing the constitutional foundations and the international instruments that support the protection of the rights of the Ecuadorian population, with the reality that is lived day by day and thus be able to receive timely responses from justice operators, which allows clarity, unification and awareness.
