    Encouraged then ordered, the advent of the safety-net clause was widely anticipated in order to stop the unconventionality. From now on, the small projects prone to have some significant impacts on the environment or the human health are allowed to be submitted to an environment assessment, after auditing the criteria of the article R. 122-3-1 of the environmental Code. However, the complex execution of this device, the blurred links with other proceedings, and the weak legal securing of the projects induced, raise doubts concerning its effectiveness over time.

    Incitée puis enjointe, l’émergence de la clause-filet était largement at- tendue afin de mettre un terme à une inconventionnalité certaine. Désormais, les petits projets susceptibles d’avoir des incidences notables sur l’environnement ou la santé humaine peuvent, après vérification des critères posés à l’article R. 122-3-1 du Code de l’environnement et examen au cas par cas, se soumettre à évaluation environnementale. Cependant, la mise en œuvre complexe de ce dispositif, le flou entourant son articulation avec les autres procédures, tout comme la faible sécurisation juridique des projets qu’elle induit, font émettre des doutes concernant son effectivité dans le temps.
