Resumen de Teletrabajo y accidente de trabajo: una aproximación a la posición de los Tribunales

En los últimos años se ha regulado el teletrabajo tanto en las Administraciones Públicas como en el sector privado. Sin embargo, esa regulación no ha abordado las cuestiones de Seguridad Social y, entre ellas, la figura del accidente de trabajo. Ello está dando lugar a la aparición de diversas sentencias donde se aborda esta cuestión y se ofrecen soluciones. El objetivo de este trabajo es analizar la posición que están adoptando los tribunales en esta materia y aportar propuestas ante una posible reforma legislativa.

In recent years, telework has been regulated both in the public administration and in the private sector. However, this regulation has not addressed Social Security issues and, among them, the figure of the accident at work. This is giving rise to the appearance of various rulings which address this issue and offer solutions. The aim of this paper is to analyse the position being adopted by the courts in this area and to make proposals for a possible legislative reform.
