Resumen de ¿El fin del outsourcing en México? Características de la nueva legislación y perspectivas de futuro

  Objetivo: analizar la subcontratación laboral en la reforma a la Ley Federal del Trabajo de México, aprobada en abril de 2021, compararla con la de 2012 y reflexionar sobre sus probables efectos en la dinámica laboral. Metodología: se compararon las dos últimas reformas para determinar qué se modificó y qué permanece en relación con la subcontratación laboral. Se revisaron los debates políticos y la dinámica cuantitativa en años recientes. Resultados: en algunos puntos los cambios son significativos; en otros, permanecen las normas anteriores. El giro más importante de la reforma atañe a los mecanismos de garantía para el cumplimiento de la norma. Limitaciones: el poco tiempo transcurrido desde la promulgación de la nueva reforma constituye la principal limitación para el análisis de sus consecuencias. Valor: el análisis y las conclusiones son un aporte novedoso a la discusión académica sobre los efectos de los giros políticos en los fenómenos sociales. Conclusiones: la reforma sobre la subcontratación presenta al mismo tiempo rupturas con la normatividad anterior y continuidad. Las consecuencias preliminares son inciertas. Hay indicios para pensar que la subcontratación laboral disminuirá de forma sustantiva, pero no la precarización.

  Objective: to analyze labor outsourcing in the 2021 La-bor Federal Law reform in Mexico versus the one ca-rried out in 2012, and to reflect on its probable effects on labor dynamics. Methodology: the comparison between the last two reforms to the Law to determine what is modified and what remains in relation to labor subcontracting. The political debates and the quantita-tive dynamics in recent years are reviewed. Results: in some aspects there are significant changes; in others, the previous regulations remain. The most important turn of the reform concerns the mechanisms to gua-rantee compliance with the norm. Limitations: the short time that has elapsed since the promulgation of the new reform constitutes the main limitation for the analysis of its consequences. Value: the analysis and the conclusions constitute a novel contribution to the academic discussion on the impacts of political tur-ns on social phenomena. Conclusions: the reform on outsourcing presents ruptures with the previous re-gulation, but it also has continuity features. The preli-minary impacts are uncertain. There are signs to think that labor outsourcing will decrease but not the preca-rious employment.
