    La minería de textos y datos (TDM) es una herramienta de vital importancia en la economía digital. TDM utiliza técnicas de procesamiento de lenguaje natural, aprendizaje automático y gestión del conocimiento para el análisis automatizado, con el fin de extraer información, tomar decisiones, identificar patrones, descubrir nuevas tendencias, insights o correlaciones. Pero, por encima de todo, TDM debe ser respetuoso con la propiedad intelectual. El legislador europeo ha entendido la relevancia de este tema y ha introducido dos excepciones imperativas al derecho de autor, para la investigación y para fines comerciales. Sin embargo, el legislador español no ha captado su real importancia y ha incorporado esta norma de manera confusa, Se quiere advertir de la necesidad de hacer cambios rápidos en la legislación española de acuerdo con la Directiva para no perder oportunidades en el mercado digital global, habida cuenta de que en el Reino Unido proyectan legislar TDM de una manera muy liberal, con el fin de ser un polo de desarrollo tecnológico en el continente.

    Text and Data Mining (TDM) is a vital tool in the tech economy. TDM uses techniques from natural language processing, machine learning, and knowledge management for the automated analysis of digital content, in order to extract information, decision making, identify patterns, discover new trends, insights or correlations. But TDM needs to be respecful with Intellectual property. The European legislator has understood the relevance of this and with that purpose has introduced two different and tailored exceptions. Nevertheless, the Spanish legislator has not capt its real importance as far as it has wrongly incorporated the UE law into our legal system. The paper wants to point out the need of fast changes in the Spanish legislation according with the Directive if we don´t want to loose chances in the european tech economy, as in the UK are planning to legislate TDM in a very much liberal way, trying to be a pole of tech development in the continent.
