Este estudio tiene por objeto el análisis y valoración crítica de la evolución normativa y jurisprudencial experimentada en el Derecho del transporte internacional de mercancías por carretera y su adscripción al ámbito material del Derecho internacional privado. En particular, el análisis se centrará en el estudio del presupuesto de validez de la cláusula arbitral en el CMR, la autonomía de la voluntad de las partes para la configuración de dicha cláusula, y la interacción entre bloques normativos.

The aim of this research is to analyze and evaluate of the normative and jurisprudential evolution experienced in the law of international carriage of goods by road and its ascription to the material scope of private international law. In particular, the analysis will focus on the study of the prerequisites for the validity of the arbitration clause in the CMR, the autonomy of the will of the parties for the configuration of such clause, and the interaction between normative blocks.
