    Pese a que la Mediación penal y la circunstancia atenuante de reparación del daño comparten objetivos y finalidades, las últimas reformas del ordenamiento español en la materia no han entendido necesaria la previsión de una atenuante de la responsabilidad penal relativa a la mediación penal intrajudicial. No obstante, la jurisprudencia existente hasta el momento permite delimitar los parámetros básicos que debe reunir el acuerdo alcanzado en el ámbito de un proceso de mediación intrajudicial como base para la apreciación de la atenuante de reparación del daño y la consiguiente reducción de la pena.

    Despite the fact that criminal mediation and the mitigating circumstance of damage repair share objectives and purposes, the latest reforms of the Spanish legal system in this area have not considered necessary to provide for a mitigating circumstance of criminal liability in relation to in-court criminal mediation. However, the existing case law to date makes it possible to delimit the basic parameters that the agreement reached in the context of an in-court mediation process must meet, as a basis for the assessment of the mitigating circumstance of reparation of damage, and the consequent reduction of the penalty.
