    La ciencia evoluciona a pasos agigantados, pero su regulación normativa normalmente queda rezagada. Tal es el caso de los derechos humanos cuando deben reinventarse, o crearse nuevos, a partir de necesidades de la sociedad. En el presente ensayo se analiza los avances de las neurociencias como punto de partida para el desarrollo delos llamados neuro derechos. Específicamente, se abarca el derecho a la integridad mental. Se intenta dar definiciones a la integridad mental que permitan dar un marco conceptual para definir el rango de protección del derecho a la integridad mental. También, se analiza los fundamentos teóricos del derecho a la integridad mental, basados en las revoluciones de la neurociencia, y su necesidad para ser regulado, y así limitar el uso incorrecto del conocimiento científico. Finalmente, se analiza críticamente la necesidad del derecho a la integridad mental, un nuevo derecho humano, independiente del paradigma iusnaturalista, sino que responde a la realidad social del momento y lugar.

    Science evolves by leaps and bounds, but its normative regulation usually lags behind. Such is the case of human rights when they must be reinvented, or new ones created, based on society’s needs. This essay analyzes theneuroscience revolution as a starting point for thedevelopment of the so-called neurorights. Specifically, it covers the right to mental integrity. An attempt is made to provide definitions to mental integrity that would allow a conceptual framework to define the range of protection of the right to mentalintegrity. Also, it studies the theoretical foundations of the right to mental integrity, based on the revolutions in neuroscience and its need to be regulated, and thus limit the incorrect use of scientific knowledge. Finally, this essays presents a critical analysis of the need for the right to mental integrity, a new human right independent of the natural law paradigm, but which responds to the social reality of the moment and place.
