La fijación del devengo del impuesto de sucesiones en el momento en que se produce la defunción del causante ha sido tradicionalmente objeto de controversia. En fechas recientes, algunos Tribunales de Justicia y la Administración Tributaria han intentado matizar el momento del devengo del impuesto en diversos supuestos, en algunos casos de manera controvertida. en el presente trabajo abordaremos dichos supuestos y veremos como la sistemática de la ley sobre el asunto, aunque discutible, es la que mejor se ajusta al fenómeno sucesorio.
The determination of the accrual of the inheritance tax at the time of the death of the decesed has traditionally been the subject of controversy. In recent times, some Superior Courts of Justice and the Tax Admninistration have tried to quality the moment of accrual of the inheritance tax in various cases, in some cases in a controversial manner. In the present work we will address these assumptions and we will see how the systematics of the law on the matter, although debatable, is the one that best adjusts to the succession phenomenon.
