    Pese a su profusa utilización en el tráfico, las arras en la compraventa encierran más de un interrogante para el práctico jurídico que se aproxima a ellas. Es por ello que analizamos el escaso régimen legal aplicable a las arras, profundizado en sus principales funciones y recogiendo los pronunciamientos judiciales más importantes. Nos detenemos especialmente en la búsqueda de la auténtica naturaleza jurídica de los llamados "contratos de arras", con una breve mención de la problemática fiscal que los rodea. Por último, destacamos algunas de las cuestiones más interesantes que suscitan las arras cuando desempeñan una función penal, cuando su régimen se equipara, por la función que las partes atribuyen a las arras, al de la cláusula penal.

    Despite its profuse use in traffic, the earnest money in the sale contains more than one question for the legal practitioner who approaches it. That is why we analyze the scarce legal regime applicable to the deposit (earnest money), delving into its main functions and collecting the most important judicial pronouncements. We stop especially in the search for the authentic legal nature of the so-called "earnest money contracts", with a brief mention of the fiscal problems that surround them. Lastly, we highlight some of the most interesting issues raised by the earnest money when payment when it performs a criminal function, when its regime is equated, due to the function that the parties attribute to the earnest money, to that of the penalty clause.
