    El presente trabajo, amén de centrarse en analizar la crítica e inconsistente relación existente entre urbanismo e inframunicipalismo, pretende ser más que un llamamiento, un grito desesperado para que los distintos poderes públicos, en concreto, los poderes legislativos tanto estatal, como, sobre todo, autonómicos, legislen ateniéndose a la realidad municipal que acontece en cada una de las diversas Comunidades Autónomas, y, por tanto, de manera acorde con los medios y capacidades de los pequeños municipios sitos en ellas, generando de este modo, a diferencia del existente, un urbanismo que al adaptarse a la realidad, resulte realmente aplicable y, por ende, efectivo y eficiente, en todos y cada uno de los mismos. Algo tan sencillo, lógico y sobre todo, coherente, como es legislar de manera distinta para quienes por múltiples motivos, lejos de ser iguales, son radicalmente distintos en prácticamente todo, hasta en su misma concepción y propósito, como resulta innegable entre los grandes y medianos municipios, por un lado, y los pequeños municipios, por otro, ha sido sistemáticamente obviado, cuando no, preterido, por los diversos legisladores de las respectivas Comunidades Autónomas, lo que denota la nula sensibilidad que han mostrado y muestran en relación con tal tipo o clase de municipios. Todo lo apuntado en el párrafo precedente debe ser matizado en alguna medida, dado que algunos legisladores autonómicos se muestran más sensibles con respecto a la situación que acontece en los pequeños municipios que se circunscriben dentro de su respectivo ámbito territorial. Sobre e] particular debo señalar que en algunas Comunidades Autónomas que han aprobado Leyes Urbanísticas recientes se percibe cierta sensibilidad hacia tales municipios, atendiendo a la carencia de medios humanos, económicos y técnicos que los caracterizan. En algunas otras Comunidades Autónomas con Leyes Urbanísticas más antiguas, se constata igualmente tal inquietud, si bien, lo cierto es que tanto en unas como en otras Comunidades Autónomas, dicha preocupación no deja de ser meramente superficial, concretándose en meros guiños que en absoluto afrontan verdaderamente el problema y menos aún, lo atajan, contribuyendo de este modo a su perpetuación. Para llamar la atención sobre tan injusta y dramática situación y de paso criticarla sin ningún tipo de ambages, he querido poner un título al presente trabajo que, a la vez que llamativo, evidencie de manera clara e incontrovertible la gran e injusta problemática urbanística a la que tienen que enfrentarse los municipios pequeños ante la pertinaz apatía y dejación de funciones de que hacen gala los legisladores autonómicos en relación con tal cuestión. Para ello y aprovechando el siempre sabio refranero español, y dentro de él, el refrán que reza: «Municipio pequeño, infierno grande», he matizado el sustantivo «infierno» añadiendo tras él, en paréntesis, el calificativo «urbanístico», con el propósito de recalcar que con la vigente legislación urbanística a eso precisamente se condena a estos últimos: a ser un infierno urbanístico.

    The present work, in addition to focusing on analyzing the critica! and inconsistent relationship between urban planning and undermunicipalism, is intended to be more than an appeal, a desperate cry for the different public powers, specifically, both state and regional legislative powers, legislate in accordance with the municipal reality that occurs in each of the various Autonomous Communities, and, therefore, in accordance with the means and capacities of the small municipalities located in thern, thus generating, unlike the existing one, an urbanism that, when adapted to reality, is truly applicable and, therefore, effective and efficient, in each and every one of them. Something so simple, logical, and above all, coherent, such as legislating differently for those who, for multiple reasons, far from being the same, are radically different in practically everything, even in its very conception and purpose, as is undeniable between large and mediumsized municipalities, on the one hand, and smaU municipalities, on the other, it has been systematically ignored, if not postponed, by the various legislators of the respective Autonomous Communities, whích denotes the lack of sensitivity that they have shown and show in relation to such type or class of municipalities.

    Everything pointed out in the preceding paragraph must be qualified some how, given that sorne regional legislators are more sensitive with respect to tlie situation that occurs in small municipalities that are located within their respective territorial scope. In this regard, I must point out that in sorne Autonomous Communities that have approved recent Urban Laws, there is a certain sensitivity towards such municipalities, given the lack of human, economic and technical resources that characterize them. In sorne other Autonomous Communities with older Town Planning Laws, such concern is also found, although the truth is that in sorne Autonomous Communities as well as in other Autonomous Communities, said concern is just superficial, materializing in simple signs that in no way truly address the problem and even less, stop it, contributing in this way to its perpetuation. In arder to draw attention to such an unfair and dramatic situation and by de way criticize it without any kind of ambiguity, I wanted to put a title to this work that, at the same time as suggestive, shows clearly and incontrovertibly the great and unfair urban problematic to which tliat small municipalities have to face in the face of the constant apathy and abandonment of functions that the regional legislators display in relation to this issue. For this, and taking advantage of the always wise Spanish proverb, and witliin it, the proverb that reads: «Small municipality, big hell», I have qualified the noun «hell» adding after it, in parentheses, the adjective «urban», with the purpose of emphasizing that with the current urban legislation, this is precisely what the latter are condemned to: to be an urban hell.
