En el año 1994 se reforma la Constitución Nacional argentina, otorgando jerarquía constitucional a los Instrumentos Internacionales que versaran sobre derechos humanos. Este cambio radical cambia la mirada hacia una política orientada al respeto por los derechos humanos, pero no es así a los largo de todo el país ya que los pueblos originarios, se ven desprovistos de sus tierras, necesarias para continuar con su cultura. Este derecho a la propiedades el que analizaremos y como lo entienden los jueces de la nación y si la aplicación del art. 75 inc 17 es realmente posible. Además analizaremos la relación de los pueblos originarios con la tierra y si encontramos alguna forma alternativa para que se respeten sus derechos

In the year 1994, the argentinian constitution was reformed, giving constitutional rank to the International Instruments that were about human rights. This radical change turned the eyes into a new politics oriented to the human rights, never the less this isn't the same all around the country, because the native people are devoid of their lands, that are necesary to continue with their culture. This property right ist what we''ll analyze y who the national judges understand it; and if the articule 75. 17 in possible to be aply. As well we'll analyze the relation of the native people with their lands and see if wee can find any alternative way to make the state respect their rights
