  La acción afirmativa halló particular precedente en el derecho de los Estados Unidos de América.Proviniendo originalmente de la práctica administrativa del estado, la acción afirmativa no era más que una serie demedidas de carácter intervencionista dentro de las prerrogativas del Presidente. Sin embargo, fue la Jurisprudencia dela Suprema Corte y su evolución que le dieron real objetividad y operatividad como medio idóneo de consagrar elderecho a la igualdad, entendiendo no solamente que “ todos los hombres eran iguales antes la ley ”; sino que a partir de laincorporación al plexo constitucional de la Enmienda 14 “ ningún estado, podrá negar dentro desu jurisdicción la protección dela ley a cualquiera desus habitantes .” Sin embargo, y pese a los esfuerzos, las carencias en la reglamentación y lasimprecisiones de conceptualización han resultado en un éxito solo parcial que palidece ante las reales posibilidades deeste instrumento protectorio

  Affirmative action was mainly developed in north american law. Originally a part of Administrative Practice,affirmative actions were conceived just as plain interventionist meisures among the many presidencial prerogatives.However, it was the Supreme Court of Justice and its evolution that provided real objectivity and operativity to it asa viable way of achieving equity, understanding not only that “every man is equal before the law” as established inthe constitution, but that from the moment in which the 14 Ammendment was incorporated to de constitution, “noState shall . . . Deny to any person within its jurisdiction the equal protection of the laws”. Yet, although significanteffort has been made, the scarce regulation of affirmative action and the imprecisions in conceptualization haveresulted in a mere partial success that mildly reflects the actual possibilities of this protective instrument
