On the basis of a recent ruling by the Court of Cassation, the Author examines the complementary relationship between the European Arrest Warrant and the European Investigation Order, in an attempt to draw the distinction between investigative needs legitimising the surrender of a person and those legitimising ‘mere'gathering of evidence.
