En el presente trabajo, analizo el derecho a la reagrupación familiar de extranjeros divorciados y vueltos a casar procedentes de países islámicos, a la luz de dos recientes e importantes sentencias del Tribunal Supremo (TS). El TS ha sentado doctrina legal, afirmando la innecesaridad del exequatur de la sentencia de divorcio del primer matrimonio, para probar que el segundo matrimonio no es poligámico de cara a la solicitud del visado y permiso de residencia por reagrupación familiar.
In this paper, I analyze the right to family reunification of divorced and remarried foreigners from Islamic countries, in the light of two recent and important Supreme Court decisions. The Court has established legal doctrine affirming the unnecessary exequatur of the divorce decree of the first marriage to prove that the second marriage is not polygamous in the face of the visa application and residence permit for family reunification.
