    La evolución tecnológica y las nuevas formas de delinquir han llevado a la prueba a un nivel transfronterizo que comporta la necesidad de regular la obtención, practica y acceso a la prueba que se encuentre o deba llevarse a cabo en un país diferente a aquel que pretende hacerla valer en la investigación o proceso judicial. Para facilitar la actividad probatoria transfronteriza, la Unión Europea ha creado la Orden Europea de Investigación, un instrumento para la obtención de prueba entre países que muestra la tendencia unificadora en esta materia. Sin embargo, la dificultad de examinar si se han cumplido los requisitos legales en el país donde debe obtenerse la prueba y la diversidad normativa pueden comprometer la salvaguarda de derechos fundamentales.
