    The social contract implies, in all human communities, the existence of rules or laws, which all members mostly comply with. In the sphere of law, it is also normal that fact precedes the regulation. It’s only sought to be regulated a fact as soon as it arises, and which may, in some way, threaten the social balance. Islamic law (al-šarī’ah) also has its limits, but Islamic society, like all human societies after all, also has those who transgress and cross the limits of law (al-ḥudūd). This work will focus on the presence of acts and practices considered more or less deviant from the ethical and moral behaviors of the Andalusian society (with the exclusion of violent crime).

    O acordo social implica, em todas as comunidades humanas, a existência de regras, normas ou leis, que todos os elementos maioritariamente cumprem. Na esfera do direito, também é norma que facto precede a lei, ou seja, só se procura regular um facto desde que ele surja e, o qual possa, de alguma forma, ameaçar o equilíbrio social.

    A lei islâmica (al-šarī’ah) também tem os seus limites, mas a sociedade islâmica, como afinal todas as sociedades humanas, tem também quem transgrida e ultrapasse os limites da lei (al-ḥudūd). É sobre a presença de atos e práticas consideradas mais ou menos desviantes à norma ética e moral da sociedade andalusi (com a exclusão do crime violento), que incidirá este trabalho.
