The paper illustrates how case-law is created in the italian legal order. It highligts the hurdles faced by the italian Supreme Court in carrying out its task to ensure the “uniform interpretation of the law”, due to the overwhelming number of appeals filed before it. Solutions to prevent case-law conflicts – even at organizational level – are then pointed out. Further, the article shows how the Supreme Court dealing with the conseguences of a too frequently occurring of overruling judments within the case-law.
L'intervento illustra le condizioni in cui si forma in Italia il diritto giurisprudenziale, mettendo in rilievo le difficoltà che la Corte di cassazione, gravata da troppi ricorsi, incontra nella sua attività di giudice di legittimità, cui è affidato il ruolo di assicurare “l'uniforme interpretazione della legge”. Vengono indicate le soluzioni, anche organizzative, praticate per evitare i contrasti di giurisprudenza e le risposte che la Corte di cassazione sta offrendo al problema degli effetti del mutamento di giurisprudenza.
