  El presente artículo tiene como objetivo analizar la Justicia Indígena desde la perspectiva de los Derechos Humanos, determinar si se vulnera o no los derechos, investigando, estableciendo y analizando la aplicación de la justicia y una posible afectación a los derechos fundamentales establecidos en la Carta Magna de nuestro país, conceptualizar lo que son los pueblos indígenas y las personas indígenas mismos que servirán para para entender la investigación, determinar el procedimiento y las sanciones que pueden emitirse por parte de las comunidades o los cabildos correspondientes, lo que si se respeta que no existan los tratos crueles, inhumanos y las torturas ya que Las comunidades o sectores indígenas están interpretando en forma absolutamente equivocada la norma constitucional, puesto que no se respetan los mínimos jurídicos, que son las garantías para todos los seres humanos. La presente investigación contiene un enfoque cualitativo, porque se trata específicamente del estudio de hechos legales que justifican la problemática.

  The objective of this article is to analyze Indigenous Justice from the perspective of Human Rights, determine whether or not rights are violated, investigating, establishing and analyzing the application of justice and a possible impact on the fundamental rights established in the Magna Carta. of our country, to conceptualize what the indigenous peoples and the indigenous people themselves are that will serve to understand the in-vestigation, determine the procedure and the sanctions that can be issued by the corresponding communities or councils, which if it is respected that there is no cruel, inhumane treatment and torture since the indigenous communities or sectors are interpreting the constitutional norm in an absolutely wrong way, since the legal min-imums are not respected, which are the guarantees for all human beings. This research contains a qualitative approach, because it deals specifically with the study of legal facts that justify the problem.
