Resumen de Guía para la entrevista judicial a una persona con discapacidad

  Ley 8/2021, sobre apoyos al ejercicio de la capacidad jurídica, ha contribuido a una incorporación más efectiva de los principios de la Convención a nuestro ordenamiento jurídico, mediante una profunda reforma de la legislación civil sustantiva y procesal. El nuevo sistema legal se basa en el reconocimiento de la igual capacidad jurídica de las personas con discapacidad, en los apoyos precisos para ejercitarla y en el respeto a su voluntad, deseos y preferencias. La concreción del apoyo más adecuado y respetuoso posible con la autonomía individual supone que el juez ha de llegar a representarse la vida pasada, presente y también futura de la persona con discapacidad, para conocer sus necesidades de apoyo en el momento de determinarlas y, en la medida en que pueda preverse, hasta la fecha en que hayan de ser revisadas. En ese proceso de determinación de la media justa e idónea para la persona, la entrevista judicial tiene una notable importancia. Sugeriremos algunas pautas de actuación para orientarla con aportaciones de otras ciencias auxiliares que pueden complementar la propia experiencia profesional del juez. Conviene que al juez no le pase inadvertida la incidencia de ciertas manifestaciones frecuentes en las personas con discapacidad, por lo que esta guía ha pretendido llamar la atención sobre ellas, sin perjuicio de la necesaria apreciación de las que pueden darse en cada persona.

  Spanish Law 8/2021, on the provision of support for the exercise of legal capacity, has contributed to more effectively incorporating the principles of the Convention into our legal system by means of an in-depth reform of substantive and procedural civil legislation. The new legal system is based on recognising the equal legal capacity of disabled people, on the support required to exercise it and on the respect for the will, wishes and preferences of such individuals. The need to ensure that the most appropriate and respectful support possible tallies with individual autonomy requires judges to represent the past, present as well as future life of the disabled person, with a view to knowing what support they need when it comes to determining it and, to the extent possible, right up until such support needs to be revised. During the process of determining the fair and appropriate support for each person, the judicial interview is of utmost importance. We propose herein some lines of action to guide such an interview process with contributions from other auxiliary sciences that can serve to complement the judge’s own professional experience. Certain manifestations that frequently present themselves in disabled people should not go unnoticed by the judge, which is why this guide has sought to highlight them, without prejudice to the necessary appreciation of any others that may occur in each person.
