Este artículo ofrece un análisis en profundidad del caso judicial de Andrés Pereira Salsberg. Describe los obstáculos y dificultades de la larga y compleja búsqueda de sus familiares para dar con su paradero. Las numerosas acciones ante los tribunales, iniciadas en 1973, finalmente concluyeron con la sentencia condenatoria dictada por la Corte Suprema el 14 de junio de 2022. Los familiares de las víctimas de desaparición forzada convirtieron su ausencia en una búsqueda activa y sostenida para alcanzar verdad, justicia y reparación a través de los tribunales. Este caso muestra el cambio de paradigma en el tratamiento del pasado conflictivo, transitando desde la impunidad de la amnistía a la sanción judicial de los responsables. Ilustra los cambios en el rol del poder judicial desde los inicios de la transición a la democracia en 1990 hasta el presente, y el reconocimiento progresivo de los derechos de las víctimas.

This article offers an in-depth analysis of the judicial case of Andrés Pereira Salsberg. It describes the obstacles and difficulties of his relatives’ long and complex search for his whereabouts. The numerous actions, initiated in 1973, finally concluded with the Supreme Court ruling of June 14th, 2022. The relatives of the victims of enforced disappearance turned their absence into an active and sustained search for truth, justice, and reparation through the courts. This case describes the paradigm shift in the treatment of the conflictive past: The transit from the impunity of amnesty to the judicial sanction of those responsible. It illustrates the changes in the role of the Judiciary from the beginning of the transition to democracy in 1990 to the present, and the progressive recognition of the victims’ rights.
