The aim of this paper is to look for ideas within the comparative law, and explain them for a constituent process in Southern Basque Country. For that purpose, we will look at Latin America, specifically to Venezuela, Bolivia and Ecuador, which are the main examples of the so-called New Latin-American Constitutionalism. In these three countries, people started constituent processes and approved new constitutions in order to get over the structural crisis they suffered (social, economical and political), producing a valuable contribution for the constituent power theory. We will look at Catalonia too.
Lan honen zioa zuzenbide konparatuan Hego Euskal Herriko prozesu konstituziogile baterako ideiak bilatu eta azaltzea izango da. Horretarako Latinoamerikara begiratuko da, Venezuela, Bolivia eta Ekuadorrera zehazki, hauexek baitira Latinoamerikar Konstituzionalismo Berria bezala ezagutu den konstitutuzionalismo berriaren adierazle nagusi. Aipatu hiru herrialdeetan, pairatzen zuten egiturazko krisia gainditu nahian (politiko, ekonomiko eta soziala) herriek prozesu konstituziogileak abiatu eta konstituzio berriak onartu zituzten, bidean irakaspen mordoa utziz. Lan honetan irakaspen horiek Euskal Herriari egin diezaieketen ekarpena azaltzeko ahalegina egingo da. Zeharka bada ere, Kataluniari ere begiratuko zaio
