    A propósito de la sentencia en estudio, se analizan los requisitos que debe cumplir la posesión para que se pueda adquirir el dominio de un inmueble por prescripción adquisitiva de conformidad a la normativa civil catalana. Junto con ello, se manifiesta una breve crítica a la figura de la prescripción adquisitiva en Cataluña, comparando su regulación con lo preceptuado por el derecho español, colombiano y estadounidense. Por último, se exponen comentarios finales a la sentencia emanada por el Tribunal Superior de Justicia en lo relativo a la valoración de la prueba y la dación en pago.

    Regarding the ruling under study, this article seeks to analyze the requirements that possession must meet so that ownership of a property can be acquired by purchasing prescription in accordance with Catalan civil regulations. Along with this, a brief criticism is made of the figure of the acquisitive prescription in Catalonia, comparing its regulation with that of Spanish, Colombian and U.S. law. Finally, a comment is presented on the judgment issued by Catalonia Superior Court of Justice regarding the assessment of evidence and the dation in payment.
