In this article we analyse the scientific failure of the positivist criminal anthropology and the attempt to revitalize it, in the 20s and the 30s of the 20th. Century, through the sciences of psychology and endocrinology. On the other side, we look at the evolution of juridical dogmatic thought and observe the development of certain concepts with a theological origin. Converging in a particular representation of the criminal, these discourses help us to understand the main institutional innovations in the criminal law ield in this period. We address the transnational, scientific and juridical, domain of which Portugal was part, and in which Fascist Italy emerged as the main reference.

Cet article analyse l’échec scientifique de l’anthropologie criminelle positiviste, ainsi que la tentative de la revitaliser, dans les années 20 et 30 du XXe siècle, par le biais de la psychologie et de l’endocrinologie. Il s’intéresse aussi à l’évolution de la dogmatique uridique et au développement de certains concepts d’origine théologique. Convergeant dans une représentation particulière du criminel, ces discours aident à comprendre les principales innovations institutionnelles dans le champ pénal durant cette période. On prend pour univers d’analyse le domaine transnational transnational, scientifique et juridique, qui englobait le Portugal, et pour lequel l’Italie fasciste constituait la principale référence.

Neste artigo analisa-se, por um lado, a falência científica da antropologia criminal positivista e a tentativa da sua revitalização, nos anos 20 e 30 do século XX, através da psicologia e da endocrinologia. Por outro, observa-se a evolução da dogmática jurídica e o desenvolvimento, neste âmbito, de alguns conceitos de origem teológica. Convergindo numa certa representação do criminoso, estes discursos ajudam a compreender as principais inovações institucionais no campo penal neste período. Tomamos como universo de análise o espaço transnacional, científico e jurídico, em que Portugal se inscreveu, e que teve na Itália fascista a sua principal referência.
