During some months of the years 2021 and 2022, the Constitutional Convention of Chile will approve a new constitutional text for that country that will be submitted to the final approval of the citizens trough a plebiscite. This constituent process has been motivated by the wishes of many Chilean citizens to leave behind the vestiges of the Pinochet dictatorship and because they have understood that the current Constitution produces a framework of domination that is not compatible with democracy or human rights. In 2019, a constitutional amendment was approved to regulate the constituent process, which provokes four reflections thinking about the Mexican reality: if all constituents should be democratically elected, if it is important to have a double plebiscite, where does the constituent reside, and what significance does transitional constitutional law have.
