After various attempts, the d.lgs. 150 of 2022, better known as the Cartabia reform, expands the scope for screening and control by the judge of preliminary investigations on the activity conducted by the Public Prosecutor. The novel assigns the judge his function of guarantor, called to express himself, also on the basis of the requests presented by the person under investigation and by the offended person. The broader powers assigned to the judge determine a significant change in his role and function and represent a first step for the opening of the so-called “jurisdiction windows” that determine non-secondary effects on the systematic and cultural level of the criminal process that the Author analyzes in a nutshell.
Dopo vari tentativi, il d.lgs. n. 150/2022, meglio noto come riforma Cartabia, amplia lo spazio di vaglio e controllo del giudice delle indagini preliminari sull’attività condotta dal pubblico ministero. La novella assegna al giudice la sua funzione di garante, chiamato ad esprimersi, anche sulla base delle istanze presentate dalla persona sottoposta alle indagini e dalla persona offesa. I più ampi poteri assegnati al giudice determinano un significativo mutamento del suo ruolo e della sua funzione e rappresentano un primo passo per l’apertura delle c.d. “finestre di giurisdizione” che determina effetti non secondari sul rito, tanto sul piano sistematico, quanto culturale che, in estrema sintesi sono affrontati, dall’Autrice.
