El creciente flujo de menores extranjeros no acompañados (MENA) que arriba cada año al territorio de la UE constituye un fenómeno tan complejo como doloroso, que plantea el considerable reto jurídico-social de otorgar una respuesta a sus necesidades y ofrecerles una efectiva protección ante el especial desvalimiento en que los sitúa su desamparo, su edad y su condición de extranjeros. Con este fin, la normativa comunitaria y española establece un régimen jurídico diverso, cuyo objetivo de atender al interés superior del menor no siempre se alcanza con satisfacción. Los déficits y carencias de este sistema han sido puestos de relieve por la jurisprudencia, cuya contribución a su mejora y corrección es objeto de este trabajo.

The growing flow of unaccompanied foreign minors who arrive each year in the EU territory constitutes a phenomenon as complex as it is painful, which poses the considerable legal-social challenge of providing a response to their needs and offering them effective protection against special helplessness in which their abandonment, their age and their status as foreigners places them. The Community and Spanish regulations establish a diverse legal regimen, whose objective of attending to the best interests of the minor is not always achieved satisfactorily. The deficits and shortcomings of this system have been highlighted by the jurisprudence, whose contribution to its improvement and correction is the subject of this survey.
