El matrimonio forzado aparece en nuestro Código Penal como delito autónomo en el artículo 172 bis y como finalidad del delito de trata de seres humanos del artículo 177 bis. En el análisis dogmático comparado de ambos preceptos, llevado a cabo mediante el estudio de la norma, doctrina relevante en la materia y jurisprudencia, se detectan algunos puntos problemáticos como las dificultades interpretativas respecto a posibles concursos de normas y de delitos o la incoherencia sistemática del marco penológico del primero de los delitos.
Asimismo, se obtienen interesantes conclusiones político criminales: unas focalizadas en dotar de mayor coherencia al ordenamiento penal y otras en coadyuvar a lograr una mayor justicia material.
Forced marriage appears in our Penal Code as an autonomous crime in article 172 bis and as a purpose of the crime of human trafficking beings in article 177 bis. In the comparative dogmatic analysis of both precepts, carried out through the study of the law, relevant doctrine on the subject and jurisprudence, some problematic points have been detected, such as the interpretative difficulties regarding possible concurrent laws and offences or the systematic incoherence of the punitive framework of the first one of the crimes. Likewise, interesting criminal political conclusions are obtained: some of these are focused on providing greater coherence to the criminal system and others on helping to a chieve greater material justice.
